The primary source of litigation against residential real estate agents in California involves disclosure of property condition issues.

Agents are responsible for completing their portion of the Transfer Disclosure Statement (TDS), and most utilize the Agent Visual Inspection Disclosure (AVID) addendum. These forms not only help inform buyers of the condition of the property they are purchasing, but they also can assist in preventing and/or reducing litigation against the agents.

  • The most common errors made in completing these forms and strategies to avoid those errors
  • Common property concerns and how to carefully discuss such matters with buyers and sellers--all with an eye to helping the client and avoiding a lawsuit.
